Previous Action/Presentation
On April 26, 2021, City Council awarded RFB No. 2021-0213-B for Sidewalk Improvements - Plano Parkway from Independence Parkway to Alma Drive, Project No. 6901, to MSB Constructors, Inc. in the amount of $2,442,179.00.
On April 6, 2022, staff administratively approved Change Order No. 1 for an increase in the amount of $11,648.24.
On August 31, 2022, staff administratively approved Change Order No. 2 for an increase in the amount of $79,193.82 and amended contract time.
On November 14, 2022, City Council approved Change Order No. 3 for an increase in the amount of $154,617.66 and amended contract time.
On January 4, 2023, staff administratively approved Change Order No. 4 to amend the contract time.
On March 19, 2024, City Council awarded a tender agreement between the City of Plano and US Casualty and Surety Insurance Company and a Completion Contract in the amount of $1,920,000 between the City of Plano and A & C Construction, Inc.
On June 10, 2024, City Council approved Change Order No. 5 for a decrease in the amount of $194,173.70 and amended contract time.
On March 18, 2025, staff administratively approved Change Order No. 6 for an increase the amount of $82,634.70 and amended contract time.
Background
The Engineering Department recommends approval of Change Order No. 7 to the completion contract with A & C Construction, Inc. in the amount of $405,916 for Sidewalk Improvements - Plano Parkway from Independence Parkway to Alma Drive.
The project experienced an extended delay following the original contractor’s default and the subsequent surety and legal process required to retain a completion contractor. Before sidewalk construction could resume, the work also had to be coordinated with an adjacent redevelopment and an overlapping wastewater project.
To avoid removing a new parking area planned by the adjacent development, the City accelerated construction of the wastewater line through the development area. The wastewater project also includes an aerial creek crossing that must be installed before the one-piece pedestrian bridge can be placed. This required the sidewalk project to remain on hold while the wastewater work advanced.
Change Order No. 7 includes:
• Restoring a sidewalk and trail segment previously removed from the contract to avoid conflict with the wastewater construction. This segment remains a City responsibility under the property dedication arrangement associated with the trail.
• Work necessary to complete the pedestrian bridge and surrounding improvements, including remobilization, demolition, grading, pavement, barrier-free ramps, signage, pavement markings, and sod.
• Updated pricing for remaining contract items due to the project’s extended delay and increased construction costs.
If the change order is not approved, the contractor will not remobilize and the sidewalk and pedestrian bridge improvements cannot be completed. Further delay would also likely result in additional cost increases.
Financial Summary/Strategic Goals
Funding for this item is available in the 2025-26 Street Improvement CIP and is planned for future years as well. The seventh Change Order to the construction contract with A & C Construction for the Sidewalk Improvements - Plano Parkway from Independence Parkway to Alma Drive project, in the total amount of $405,916, will leave a balance of $163,857 for future expenditures.
Approval of this item will support the City's Strategic Plan Critical Success Factor of being an Excellent, Innovative, and Accountable City Government.
