Previous Action/Presentation
The Plano City Council considered and approved the most recent ordinance of necessity for a Community Investment Program project at its April 13, 2026 meeting, for the Diamond Intersection Safety Improvements - CMAQ project. This action marked the start of a new practice: City staff now seek Council approval to use eminent domain earlier in the land rights acquisition process for street and utility projects to avoid prolonged delays. As with any legal action, staff will not proceed with condemnation without first consulting the City Council.
The Plano City Council approved an expenditure in the amount of $374,800 for engineering professional services for the G Avenue Paving and Water Improvements - 14th Street to 15th Street, Project ENG-CMB-00008 (G Ave Project), at its June 10, 2024, meeting.
Background
The City requires two proposed sidewalk easements for the G Ave Project.
The first easement, located along the street frontage of 1436 G Avenue, is a sidewalk easement required from the future common area property for the 15th Street Townhomes development. The proposed easement will be used to install a 10’ wide hike and bike trail along the east side of G Avenue.
The second easement, located immediately south of the first along the front of 1410 G Avenue, is also a sidewalk easement required from the office property at this location which will be used to install a 10’ wide hike and bike trail along the east side of G Avenue as well.
Not adopting this ordinance may result in project delays, easement acquisition expenditures well above fair market value, deviation from street design standards established for downtown Plano, and/or removal of improvements at these locations from the scope for this bond funded construction project.
This item was prepared in collaboration with the Engineering Department. Staff recommend adoption of this Ordinance.
