Item Summary

title

To approve an interlocal cooperation contract by and between the City of Plano and the Department of Public Safety for the Plano Municipal Court to securely submit conviction records to the State; and authorizing the City Manager to execute all necessary documents.

body

Background

Texas Transportation Code Chapter 543.201 requires the Clerk of the Court to keep a record of each case in which a person is charged with a violation of the law regulating the operation of vehicles on highways. This record must include name, address, date of birth, and driver’s license number of the person charged and be made on a form or by a data processing method acceptable to the Department of Public Safety (DPS). Convictions associated with these records must be submitted to the Department of Public Safety not later than the seventh day after the date of conviction.

Conviction reports are currently uploaded and submitted electronically to a secure DPS website. Effective January 1, 2027, DPS will be implementing a new Texas Conviction Reporting interface (TXCR) which will eliminate the current submission process. This transition requires users to complete an Interlocal Cooperation Contract to be executed under Texas Government Code Chapter 791. There is no cost associated with this agreement.

The transition to TXCR applies to all Texas courts and will be the only resource for reporting convictions effective January 1, 2027. Completion of this contract will allow the Plano Municipal Court to continue reporting as mandated by Texas Transportation Code Chapter 543.203.
